Terms of Use

By using Tunery you accept all of the terms below in full.

Parties and Acceptance

These Terms of Use are entered into between Gkc Technology Elektronik Ticaret Limited Şirketi (the "Company", "we") and the individual using the Tunery application (the "App", the "Service") ("you", the "User"). By downloading the App, creating an account, or using the Service in any way, you represent that you have read, understood, and unconditionally accept these Terms, the Privacy Policy, and all purchase rules presented within the App. If you do not accept these Terms, you must not use the App and must delete it immediately.

Description of the Service

Tunery is an application that lets users create, edit, and preview AI-based images and videos of vehicle modifications based on photos they upload. The Service is provided "AS IS" and "AS AVAILABLE". The Company does not warrant that the Service will be uninterrupted, error-free, or that it will meet any particular standard of quality, accuracy, or expectation. Generated visuals are illustrative and do not guarantee any real-world result, product, color, or fitness.

Account and Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service and make paid purchases only with the permission and supervision of your parent or legal guardian. You are solely responsible for the accuracy of your account information and for the security of your account. You are responsible for all activity that occurs under your account. The Company may refuse to open an account or close your account at any time, without cause and without prior notice.

Acceptable Use and Prohibitions

You agree to use the Service only for lawful purposes. The following are strictly prohibited: uploading images owned by others or protected by copyright or personality rights without authorization; producing obscene, illegal, violent, hateful, or misleading content involving third parties; reverse-engineering the Service, overloading it with automated tools, or circumventing security measures; reselling the Service or using it for unauthorized commercial purposes. If these rules are violated, the Company may immediately suspend or close your account, in which case no refund will be made for any unused credits or subscription fees.

User Content and License

You warrant that you hold all rights, permissions, and authorizations necessary for every image you upload ("User Content"). You bear all legal responsibility arising from User Content. By uploading User Content, you grant the Company a worldwide, royalty-free, sublicensable right to process, reproduce, and store that content for the purpose of providing, operating, improving, and delivering the Service. The Company reserves the right to remove, without prior notice, any content it deems unlawful.

AI-Generated Content

Outputs produced by artificial intelligence are probabilistic; their accuracy, fidelity to reality, or fitness for a particular purpose is not guaranteed. You are solely responsible for the use and sharing of generated content and for any consequences it may cause. The Company does not warrant that generated content does not infringe the rights of third parties and cannot be held liable for any claims arising from the use of such content.

Intellectual Property

The intellectual property rights in the App itself, the "Tunery" brand, logo, interface, software, modification catalog, preset templates, and all components belong exclusively to the Company. Your use of the Service grants you no right in these elements other than a limited, personal, non-transferable, and revocable right of use.

Subscription Terms

Tunery may offer recurring subscriptions for access to certain features (e.g., watermark removal, additional generation allowances). Subscriptions are purchased and billed through the Apple App Store; payment renews automatically at the end of the period you select. To stop renewal, you must cancel the subscription through your App Store account at least 24 hours before the current period ends. Cancellation takes effect at the end of the current period; no partial refund is given for a period already started. If a free trial is offered and not canceled before it ends, the subscription automatically converts to a paid period.

Credit Terms

Credits are digital consumable units used to perform generation operations within the Service. Credits are deemed delivered as digital content at the moment of purchase. Credits have no cash value; they are non-transferable, cannot be moved to other accounts, are non-refundable, and cannot be claimed as money. The Company may set an expiry period for credits and may change package contents and the number of credits a generation operation consumes at any time. If an account is closed or suspended, any remaining credits become void without being subject to any refund.

Refunds and Right of Withdrawal (All Sales Are Final)

All sales are final, and the Company makes no refunds for purchased subscriptions or credits. Credits and digital subscription content are digital content/services performed immediately by electronic means at the moment of purchase. By confirming a purchase, you expressly consent to the immediate delivery of the content and waive your right of withdrawal under applicable distance-selling legislation. No refund may be claimed for unused credits, partially used subscription periods, or features you did not use. Refund requests made to Apple through the App Store are entirely at Apple's discretion; the Company has no control over refunds granted by Apple, and any such refund does not alter the Company's policy in this clause. This clause applies without prejudice to the mandatory provisions of applicable consumer legislation.

Pricing and Changes

The Company reserves the right to change subscription and credit prices, package contents, and feature scope at any time. Price changes apply to purchases made after they take effect; the current price applies to the renewal of an existing subscription period.

Disclaimer of Warranties

The Service is provided "AS IS" without any express or implied warranty. The Company gives no warranty whatsoever, including warranties of merchantability, fitness for a particular purpose, uninterrupted operation, absence of errors, or accuracy of results. The risk of using the Service is entirely yours.

Limitation of Liability

To the maximum extent permitted by applicable law, the Company shall in no event be liable for indirect, incidental, special, punitive, or consequential damages, loss of data, loss of profit, or loss of reputation. In any event, the Company's total liability is limited to the amount actually paid to the Company by the relevant User in the three (3) months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless the Company, its directors, and its employees against any and all claims, lawsuits, damages, and costs (including reasonable attorneys' fees) arising from your use of the Service, your breach of the Terms, or your User Content.

Suspension and Termination

The Company may suspend, restrict, or terminate the Service or your access to your account at any time, without cause, without prior notice, and without incurring any liability to compensate. Upon termination, no unused credits or subscription fees are subject to refund.

Changes to the Terms

The Company may unilaterally change these Terms at any time. The updated Terms take effect the moment they are published within the App. Your continued use of the Service after a change means you accept the updated Terms.

Force Majeure

The Company cannot be held liable for disruptions arising from natural disasters, war, epidemics, outages caused by infrastructure or third-party service providers, cyberattacks, and similar events beyond the Company's reasonable control.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The Courts and Enforcement Offices of İstanbul (Çağlayan) have jurisdiction over disputes between the parties. The mandatory provisions regarding the application rights of users who qualify as consumers and the competent consumer arbitration committee/court are reserved.
